This document is a plain-language statement of the agreement between ICS Tracker and you, the user. Read it. If you don't agree, don't use the service.

1. Who we are

"ICS Tracker", "we", "us", and "our" refer to the operator of icstracker.io, based in Costa Rica. We operate the ICS Tracker search engine and the TrackerNodes scanning technology that powers it. "You" and "your" refer to the individual or entity that uses the service.

2. What ICS Tracker is

ICS Tracker is the search engine you interact with at icstracker.io. It indexes publicly reachable Industrial Control System (ICS) and Operational Technology (OT) devices on the internet.

The search engine is powered by TrackerNodes, our proprietary in-house scanning technology. TrackerNodes performs the internet-wide probing on Modbus, DNP3, BACnet, OPC-UA, and follow-up port sweeps; it collects banner data, TLS certificates, and screenshots of internet-facing web panels. ICS Tracker presents the indexed results; TrackerNodes generates them.

We do not sell, rent, or distribute scan data sourced from third parties. All data shown by ICS Tracker is collected first-party by TrackerNodes.

3. Accounts

To use most features you must register an account with a valid email address. You are responsible for safeguarding your password and any API token issued to you. You must promptly notify us of any unauthorized access to your account. You may not share an account with another person.

4. Acceptable use

You may use ICS Tracker for lawful security research, asset inventory, threat intelligence, vulnerability management, journalism, academic study, and authorized penetration testing.

5. Prohibited conduct

You agree NOT to use ICS Tracker, in whole or in part, to:

6. Subscriptions, billing, and refunds

Paid plans are billed by our Merchant of Record, Lemon Squeezy (Saasquatch Ltd, Ireland). Lemon Squeezy is the legal seller of subscriptions; ICS Tracker is the service provider. Their Terms of Service and Privacy Policy also apply to your purchase.

Subscriptions auto-renew at the end of each billing period until cancelled. You may cancel from the Customer Portal at any time. Cancellation stops future charges; it does not retroactively refund the current period.

Refunds for the current period may be requested within 7 days of the charge by emailing [email protected]. We review requests case by case.

Prices are quoted in US dollars and exclusive of taxes. Lemon Squeezy collects and remits VAT and sales tax as required by your jurisdiction.

7. Intellectual property

The TrackerNodes scanning technology, including its source code, fingerprints, protocol parsers, scanning methodologies, and screenshot pipeline, is our proprietary property and trade secret.

The ICS Tracker brand, web interface, search-operator language, API contract, and the structured presentation of indexed data are our property as well. Individual data points about reachable internet-facing devices are facts and not copyrightable; the collection, ranking, enrichment, and curation of those facts is.

You retain ownership of any query you submit. We may use aggregated, de-identified query patterns to improve ICS Tracker and TrackerNodes.

8. Data and privacy

We log your account, billing identifiers, IP address, search queries, and usage counts in order to operate the service, enforce quotas, prevent abuse, and fulfill legal obligations. We do not sell your personal data. We do not publish your queries.

If you are an EU/UK resident, you have rights under the GDPR/UK GDPR to access, correct, export, or delete personal data held about you. Contact [email protected].

9. Disclaimer of warranties

The service is provided "as is" and "as available". We make no warranties, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted, error-free, complete, or current. We do not warrant the accuracy of indexed banner data, geolocation, or vendor attribution.

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall ICS Tracker, its operators, employees, or agents be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, data, business opportunity, or goodwill, arising out of or in connection with your use of the service, even if advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or relating to these terms or the service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100.

11. Indemnification

You agree to indemnify and hold harmless ICS Tracker and its operators from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the service, (b) your violation of these terms, or (c) your violation of any law or third-party right.

12. Termination

You may stop using the service at any time. We may suspend or terminate your account immediately, without notice, if we reasonably determine that you have violated these terms, that your use poses a security or legal risk, or that your account has been used to compromise third-party systems.

13. Changes to these terms

We may modify these terms. Material changes will be notified via the service or by email. Your continued use of the service after the effective date of a change constitutes acceptance of the modified terms. If you do not agree, you must stop using the service.

14. Governing law and disputes

These terms are governed by the laws of the Republic of Costa Rica, without regard to its conflict-of-laws rules. The competent courts of San José, Costa Rica shall have exclusive jurisdiction over any dispute arising out of these terms, except that we may seek injunctive relief in any competent court.
